Terms of Use

Last updated:

These Terms of Use (the “Terms”) govern your use of the heatmeup.app website and the heatmeUp mobile application (together, the “Service”), published by HMU Technologies (the “Publisher”), whose details are listed in the legal notice.

By accessing the website or installing the app, you acknowledge that you have read and accepted these Terms without reservation. If you do not agree with all or part of these Terms, you must stop using the Service and uninstall the app.

1. Description of the Service

heatmeUp is a personal journal. It lets you log your encounters (friendly, romantic or sexual), attach contextual information to them and keep track of your sexual health. The Service includes in particular:

  • a form to add encounters (date, hookup or both), with optional and customisable fields;
  • profiles per person, a calendar, events (parties with a date and place), a map of places and statistics by period;
  • an optional health module: PrEP tracking (on demand, daily or injectable), reminders for STI tests, treatments or DoxyPEP, STI records and help notifying partners;
  • privacy features: passcode and biometric lock, incognito mode by category, shake to hide;
  • backup and restore via a CSV file.

The Service works without a user account. The data you enter is stored locally on your phone; the journal is kept in the encrypted storage provided by the operating system. The Publisher has no access to this data.

At your request, the Service may rely on third-party technical services, for example a mapping service for address search, or the external website previensmoi.fr to notify a partner anonymously. These third-party services are governed by their own terms.

heatmeUp is not a medical device. It is not intended to provide a diagnosis, recommend a treatment or provide medical follow-up.

2. Eligibility

The Service is intended for people aged at least 16.

  • By using heatmeUp, you represent that you are at least 16 years old. If you are under 18, you are responsible for ensuring that using the app is permitted under the rules applicable in your country and, where relevant, by your parents or guardians.
  • You agree not to use the Service to collect or share data about minors.
  • You must not use the Service if the law of your country prohibits this type of tool or content.

3. Medical disclaimer

heatmeUp is a self-tracking and organisation tool. It is not a substitute for medical consultation or follow-up by a healthcare professional.

  • The information, reminders, suggestions, protection or risk windows and statistics shown in the app are calculated for guidance only. They may be incomplete, approximate or wrong.
  • Nothing in the app or on the website (including the guides) constitutes personalised medical advice, diagnosis or recommendation.
  • If you have doubts, symptoms, have been exposed to a risk or face an emergency, contact a doctor, a sexual health clinic, an emergency department or your local emergency number without delay.
  • You remain solely responsible for how you interpret the information provided and for decisions about your health.

4. Your responsibilities

You are solely responsible for how you use the Service, the data you record in it and the consequences. In particular, you agree to:

  • protect access to your device (passcode, biometrics) and, if you wish, enable the lock offered by heatmeUp;
  • only enter information you are comfortable keeping on your own phone and, where relevant, inform the people concerned of how you use their data;
  • not use heatmeUp to harass, threaten, shame or harm anyone, or to keep or share unlawful or non-consensual content;
  • not use the app to monitor or control another person without their consent;
  • back up your data regularly using the CSV export: deleting the app, changing device or resetting your phone may cause permanent data loss.

Because the Publisher has no access to the data stored on your phone, it cannot restore information that has been deleted or lost.

5. Prohibited uses

You must not use the Service to:

  • collect, store or share sexual content involving minors or people lacking full legal capacity;
  • record or share images, videos or information without the consent of the people concerned, in particular for blackmail, harassment or non-consensual sharing;
  • attempt to bypass, disable or alter any security, encryption or access-control mechanism of the app or the operating system;
  • reverse engineer, decompile, copy or modify the app’s code beyond what the law allows;
  • use the Service for unlawful or fraudulent purposes.

If clearly unlawful use is brought to its attention, the Publisher may take any appropriate measure, including cooperating with the competent authorities.

6. Intellectual property

The trademarks, logos, graphics, interfaces, texts and, more generally, all elements of the Service, except the content you record yourself, are protected by intellectual property law and remain the exclusive property of the Publisher or its partners.

Any unauthorised reproduction, representation, modification or reuse of all or part of the Service is prohibited without the Publisher’s prior written consent.

7. Free service and in-app purchases

As of the date these Terms were last updated, the Service does not offer any paid features.

If in-app purchases or subscriptions were introduced, they would be presented clearly in the app before any purchase, and:

  • payments would be processed exclusively by the distribution platforms (Apple App Store, Google Play); the Publisher would never have access to your payment details;
  • billing, renewal and cancellation terms would be those of the relevant platforms, manageable from your Apple or Google account settings;
  • unless mandatory law provides otherwise, refund requests would be handled by the platforms, under their own policies.

These Terms would then be updated accordingly.

8. Personal data

How your personal data is processed, including data about health and sexual life, is described in the Privacy Policy. By using the Service, you acknowledge that you have read it.

9. Limitation of liability

To the maximum extent permitted by law, the Publisher shall not be liable for any indirect damage (including loss of data, loss of opportunity or harm to reputation) resulting from the use of, or inability to use, the Service.

The Publisher does not warrant that the Service will be free of errors, bugs or downtime, nor that the information displayed (reminders, protection calculations, statistics, content) is accurate. You are responsible for checking any important information against reliable sources, especially regarding health.

10. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable solution, the French courts shall have jurisdiction.

In accordance with the French Consumer Code, you may use a consumer mediator free of charge to seek an amicable resolution of a dispute.

11. Changes to the Service and the Terms

The Publisher may change the Service and these Terms to reflect technical, legal or functional developments. The version in force is the one published on this page. By continuing to use the Service after an update, you accept the new Terms.
